Your data your business, FiboFan is the facilitator of you business.
This means that while we may use your content as described above, you retain ownership of your data and remain in control of how you use it.

4.3 Monitoring and Enforcement:
We reserve the right to monitor and review all User Content and may remove any content that violates these Terms or is deemed inappropriate at our sole discretion.

7. Disclaimer of Warranties

7.1 General Disclaimer:
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIBOFAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 No Guarantee of Availability:
FiboFan guarantees that it will make all reasonable efforts to keep the Services live and operational with minimum possible interruption. However, FiboFan does not warrant that the Services will be completely uninterrupted or error-free, or that any defects will be corrected, and we shall not be liable for any interruptions or errors that may occur.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIBOFAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

8.2 Aggregate Liability:
IN NO EVENT SHALL FIBOFAN’S AGGREGATE LIABILITY EXCEED THE AMOUNT PAID, IF ANY, BY YOU TO ACCESS THE SERVICES DURING THE SIX (6) MONTHS PRECEDING THE INCIDENT.

9. Indemnification

You agree to indemnify, defend, and hold harmless FiboFan, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or related to your use of the Services, violation of these Terms, or infringement of any intellectual property or other rights of any person or entity.

You may terminate your account at any time by following the account termination procedures provided within the Services. However, termination of your account does not relieve you of any obligations incurred prior to termination.

We reserve the right to suspend or terminate your access to the Services at any time and for any reason, including but not limited to a breach of these Terms or conduct that could harm other users or the reputation of FiboFan.
